The Lebanese Central Bank issued on May 8, 2026 intermediate decision number 13817 under intermediate circular no. 763 which amends basic decision number 6895 under basic circular 38 regarding deposits, checks, transfers and transfer orders pertaining to the public sector. In details, the circular was amended to also include lending facilities to the public sector, and requires banks to refrain, unless under exceptional circumstances cited in legal passages, from doing the following operations:
- Accepting deposits from the public sector, whether in the name of the entity directly or in the name of one of their employees or beneficiaries;
- Accepting checks, transfers, or transfer orders for any person from the public sector; and
- Granting lending facilities to public sector individuals
The circular finally requested banks to provide BDL, and on a monthly basis, with details of public sector deposits held with them and/or the credit facilities granted to the public sector, which according to the circular encompasses public administrations, municipalities, the N.S.S.F, independent agencies only to name a few. The circular goes into effect stating end of May 2026.
أَصدَرَ مصرف لبنان بتاريخ 8 أيّار 2026 القرار الوسيط رقم 13817 تحت إطار التعميم الوسيط رقم 763 والذي عدّل القرار الأساسي رقم 6895 تحت إطار التعميم الأساسي رقم 38 و المتعلّق بالودائع والشيكات والحوالات وأوامر الدفع العائدة لصالح القطاع العام. بالتفصيل، فقد تمّ تعديل التعميم ليشمل أيضاً التسهيلات الائتمانيّة الممنوحة للقطاع العام، كما وألزم المصارف بالامتناع إلّا في الحالات الإستثنائيّة المذكورة في النصوص القانونيّة، عن القيام بالعمليّات التالية:
- قبول الودائع من القطاع العام، سواء باسم الشخص العام مباشرةً أو بإسم أحد موظّفيه أو المستفيدين منه؛
- قبول الشيكات أو الحوالات أو أوامر الدفع لأي شخص من القطاع العام؛ و
- منح تسهيلات ائتمانية لأشخاص القطاع العام.
كما وطلب التعميم من المصارف تزويد مصرف لبنان بصورة شهريّة، بتفاصيل ودائع القطاع العام لديها و/أو التسهيلات الائتمانيّة الممنوحة للقطاع العام، والذي يشمل وفقاً للتعميم الإدارات العامّة والبلديّات والصندوق الوطني للضمان الإجتماعي والهيئات المستقلّة على سبيل المثال لا الحصر. أخيراً يدخل هذا التعميم حيّز التنفيذ إعتباراً من نهاية شهر أيار 2026.
