The Lebanese Ministry of Finance recently announced that it introduced an addendum to the Republic of Lebanon Eurobond contracts (a total of 29 issues) that suspends the government’s right to assert defenses to any legal actions in respect of the Eurobonds issued by it based on the expiration of the New York statute of limitations until March 9, 2028. This step comes in light of the Council of Ministers’ decision number 30, dated January 7, 2025 in this regard, which aimed to minimize the risk of a lawsuit by bondholders and to facilitate the development and finalization of an orderly restructuring plan, always according to the ministry. The Ministry also commented that the addendum is based on Article 23.1 of the amended and updated agreement dated March 1, 2010, which allows the state to unilaterally introduce changes to the contract, as long as said changes do not affect the rights of any bondholders in a negative manner.
أعلنت وزارة الماليّة مؤخّراً بأنّها أبرمت ملحق لإتفاقية الوكالة الماليّة لسندات اليوروبوند المصدرة من الجمهوريّة اللبنانيّة (ما مجموعه 29 إصدار( لتعكس تعليق حقّ الدولة بالإدلاء بدفوع مرور زمن المهل التعاقديّة والقانونيّة وفقاً لقانون ولاية نيويورك لغاية 9 آذار 2028 وذلك إنفاذاً لقرار مجلس الوزراء رقم 30 تاريخ 7/1/2025 في هذا السياق والذي هدف حينها إلى الحدّ من المخاطر التي يمكن ان تتعرض لها الدولة من جراء مقاضاتها من قبل حاملي السندات، وفسح المجال أمام وضع وإتمام خطة لإعادة هيكلة منتظمة لمحفظة اليوروبند. وقد تمّ توقيع هذا الملحق إستناداً الى المادة 23.1 من إتفاقيّة الوكالة الماليّة المعدلّة والمحدثّة بتاريخ 1 آذار 2010، والتي تنصّ على أنّه يجوز للدولة إبرام تعديلات للإتفاقيّة دون موافقة حاملي سندات اليوروبوند، لإجراء أي تغيير لا يؤثّر سلباً على حقوق أي من حاملي السندات.
